Welcome to Ekilibrio. These Terms & Conditions (“Terms”) govern your access to and use of the Ekilibrio online store and your purchase of products from Ekilibrio LLC (“Ekilibrio,” “we,” “us,” or “our”).
By accessing our website, placing an order, or purchasing merchandise from Ekilibrio, you acknowledge that you have read and agree to these Terms & Conditions.
Ekilibrio specializes in lighting fixtures, decorative lighting, accessories, and related products.
We make reasonable efforts to accurately display product descriptions, dimensions, specifications, finishes, colors, and photographs. However, colors and finishes may appear differently depending on lighting conditions, photography, computer screens, and mobile devices.
Customers are responsible for reviewing all product dimensions, specifications, electrical requirements, finishes, quantities, and installation requirements before placing an order.
All prices are listed in U.S. dollars unless otherwise indicated.
Prices may change without prior notice. Applicable taxes, including Puerto Rico sales and use tax (IVU), shipping, delivery, handling, installation, and other applicable charges may be added to the purchase price.
In the event of an obvious pricing, typographical, technical, or product-information error, Ekilibrio reserves the right to correct the error and, where legally permitted, cancel or modify an affected order. If payment has already been collected for an order that is properly cancelled, the applicable amount will be refunded.
An order submitted through our website constitutes an offer to purchase merchandise.
Receipt of an automated order confirmation does not necessarily constitute final acceptance of the order. Orders may be subject to product availability, payment authorization, fraud prevention, and verification of product or shipping information.
If an item becomes unavailable after an order is placed, we will contact the customer regarding available alternatives, backorder options, or an applicable refund.
Full payment is generally required when an online order is placed unless Ekilibrio expressly agrees otherwise in writing.

Orders may be delayed or cancelled if payment cannot be authorized or verified.
Products identified as Special Order, Custom Order, Made-to-Order, Customized, or Final Sale may be ordered specifically for the customer.
Because these products may be manufactured, imported, finished, configured, or purchased specifically for an individual order, special and custom orders may not be cancelled, changed, returned, or exchanged once processing has begun, except where otherwise required by applicable law or in cases involving qualifying defective, damaged, or incorrectly supplied merchandise.
Customers are responsible for carefully verifying dimensions, finish, color, voltage, specifications, quantities, and other selections before approving a special or custom order.
Any estimated production or delivery date for a special-order product is an estimate and not a guaranteed delivery date unless expressly stated otherwise in writing.
Shipping and delivery times shown on our website or provided by Ekilibrio are estimates unless expressly guaranteed in writing.
Delays may occur because of manufacturers, suppliers, carriers, ports, customs, weather, transportation disruptions, inventory availability, or other circumstances outside Ekilibrio's reasonable control.
Shipping and delivery charges, when applicable, will be disclosed during checkout or separately quoted.
Customers are responsible for providing complete and accurate shipping and contact information.
Additional charges resulting from an incorrect address, unsuccessful delivery attempt, special handling requirement, storage, redelivery, or other customer-requested service may be the customer's responsibility where permitted by law.
Customers should inspect merchandise promptly upon receipt.
If a package appears significantly damaged during transportation, the customer should document the condition of the package and merchandise with photographs before discarding the original packaging.
Damage, missing components, incorrect merchandise, or other problems should be reported to Ekilibrio as soon as reasonably possible, together with the order number and photographs when applicable.
Customers should retain the merchandise and original packaging while a shipping-damage or product claim is being evaluated.
Returns and exchanges are governed by Ekilibrio's Return & Refund Policy as displayed on our website and by applicable Puerto Rico consumer law.

Merchandise that has been installed, modified, altered, assembled, cut, wired, or damaged after delivery may not qualify for a discretionary return or exchange.
Special-order, custom, clearance, and merchandise specifically identified as Final Sale may be subject to additional restrictions, except to the extent a remedy is required by applicable law.
Nothing in this policy is intended to eliminate or restrict any consumer right or remedy that cannot legally be waived, including applicable rights concerning defective merchandise or merchandise that does not conform to representations made in connection with the sale.
Unless the return results from an error by Ekilibrio, qualifying defective merchandise, or another circumstance for which Ekilibrio is legally responsible, the customer may be responsible for return shipping and related transportation expenses.
Merchandise should not be returned without following Ekilibrio's applicable return authorization procedure.
If merchandise arrives damaged, defective, incomplete, or materially different from the product ordered, please contact Ekilibrio promptly.
We may request photographs, packaging information, product labels, serial numbers, or other reasonable documentation needed to evaluate the claim.
Depending on the circumstances and applicable law, an appropriate remedy may include repair, replacement, exchange, refund, or another legally available solution.
Certain products sold by Ekilibrio may include a manufacturer's warranty.
Warranty duration, coverage, exclusions, and procedures vary by manufacturer. Where applicable, warranty claims may be subject to the manufacturer's terms and procedures.
Ekilibrio does not independently extend a manufacturer's warranty beyond the manufacturer's stated terms unless Ekilibrio expressly provides a separate written warranty.
Nothing in this section limits rights or remedies available under applicable law.
Lighting products should be installed by a properly qualified professional and in accordance with manufacturer instructions, applicable electrical requirements, building requirements, and safety standards.
Before purchasing a fixture, customers are responsible for confirming that the intended installation location can safely accommodate the fixture's dimensions, weight, mounting system, voltage, electrical requirements, and other specifications.
Unless installation services are expressly included in the customer's written order, product prices do not include installation.
Ekilibrio is not responsible for damage resulting from improper installation, unauthorized modification, misuse, or installation contrary to manufacturer instructions, except to the extent responsibility cannot legally be excluded.
Products displayed online may become unavailable or may be discontinued by the manufacturer without prior notice.
If Ekilibrio cannot fulfill an order, we may contact the customer to offer an alternative product, place the item on backorder with the customer's agreement, or provide an appropriate refund.
Promotional codes, discounts, sales, and special offers may be subject to separate conditions, expiration dates, exclusions, minimum purchases, and product restrictions.
Unless expressly stated otherwise, promotions cannot be combined.
We attempt to maintain accurate and current website information. However, occasional typographical, technical, pricing, inventory, photographic, or descriptive errors may occur.
Ekilibrio may update or correct website information when necessary, subject to applicable consumer-protection requirements.

To the fullest extent permitted by applicable law, Ekilibrio will not be responsible for indirect, incidental, special, or consequential damages arising from circumstances for which such liability may lawfully be limited.
Nothing in these Terms excludes or limits liability or consumer remedies that cannot legally be excluded or limited under applicable law.
Personal information collected through the Ekilibrio online store will be handled in accordance with our Privacy Policy and applicable law.
Payment information may be processed by third-party payment processors according to their applicable privacy and security practices.
Ekilibrio reserves the right to request reasonable verification before processing an order when necessary to prevent fraud or unauthorized transactions, subject to applicable law.
Orders reasonably suspected of fraud or unauthorized payment activity may be delayed or cancelled.
These Terms & Conditions and transactions with Ekilibrio shall be governed by the applicable laws of the Commonwealth of Puerto Rico and applicable federal law.
Nothing contained in these Terms is intended to waive any right or remedy that a consumer cannot legally waive.
Ekilibrio may revise these Terms & Conditions periodically.
Changes will apply prospectively from the effective date of the revised Terms, except where applicable law requires otherwise.
